Bombay High Court Lifts Interim Order on Maharashtra Public Trusts Contributions

Sept 2009 order has been vacated by the High Court on Charity Commissioner Contribution by a Public Charitable Trust

The Bombay High Court had passed an interim order dated 25th September 2009 restraining Maharashtra Government from collecting any contribution under section 58 of the Maharashtra Public Trusts Act, 1950 from the public trusts registered under the said Act.


Vide order dated 16th July 2025, the High Court has disposed off the petition and vacated the interim order. Essentially, the State Government is now given liberty to assess its current factual situation regarding funds available with it and pass appropriate fresh order pertaining to levy of contributions from the trusts to the fund.


While the matter is not clear, it appears that Court has directed the State Government / Charity Commissioner to not levy any contribution in arrears for the past years.
